Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("User") and Talent Limited AI Studio ("we"), the operator of live.ai. By registering or using the live.ai app ("the Service") you agree to be bound by these Terms.

1. The Service

live.ai is an iOS app that uses cloud AI models to turn a still image you provide into a short AI Live Photo video. Output can be saved as a standard Apple Live Photo to your Photos library, or exported as an MP4.

Video generation relies on third-party AI providers (Volcengine, Alibaba Cloud Tongyi Wanxiang, Fal.ai, Kling, etc.). Quality, duration and availability depend on those providers' APIs and quotas. We use reasonable efforts to maintain uptime but make no guarantee of specific results.

2. Accounts

• Registration uses Sign in with Apple. Keep your Apple ID credentials safe.
• One Apple ID = one live.ai account. Selling, sharing, or bulk-registering accounts is prohibited.
• We may suspend or terminate accounts that breach these Terms or applicable law, without refunding consumed credits.
• To close your account, follow §5 of the Privacy Policy.

3. Credits & Payment

3.1 Credit System

• Welcome bonus: 20 credits on signup (≈ 2 × 720P clips).
• Cost: 10 credits / 720P clip; +4 credits for 1080P (14 credits total).
• Bonus credits are non-cashable, non-transferable and non-refundable.

3.2 Pricing (App Store In-App Purchase)

Actual prices follow what the App Store displays; regional taxes and FX may differ. We may adjust pricing or bonus ratios going forward without affecting credits already in your balance.

3.3 Billing

All billing is handled by Apple's In-App Purchase. After a successful payment we verify the receipt via Apple's verifyReceipt API and post credits to your balance. We never directly handle your payment instruments.

3.4 Refunds

• Credits are virtual digital goods; consumed credits are non-refundable.
• For unused credits, submit a refund request via the App Store "Report a Problem". Refunds are decided and executed by Apple; upon a refund we deduct the corresponding credits from your balance.
• If a refund causes your balance to go negative, you must top up before continuing to use paid features.
• For generations that fail due to provider-side errors, we automatically refund the consumed credits (including bonus credits) — no request needed.

4. Acceptable Use

You agree not to upload, generate or distribute content that:

• Violates Chinese law (national security, sovereignty, ethnic unity, etc.)
• Contains terror, extreme violence, or gore
• Is pornographic, sexually suggestive, or inappropriate involving minors
• Uses another person's likeness, voice, or name without lawful authorization — including deepfakes of celebrities or impersonation for fraud
• Infringes copyright, trademark, patent, or other IP
• Promotes fraud, false advertising, MLM, gambling, drugs, or any illegal activity
• Attacks, harasses, defames or threatens others

We and our providers may moderate all uploads. On violation we may immediately stop generation, withhold output, refuse credit refunds, suspend or terminate the account, and report to authorities where applicable.

5. Intellectual Property

• Your inputs: you must own or be properly licensed for any image you upload. You are solely responsible for infringement claims arising from your uploads.
• Generated output: subject to your compliance, you may use the generated video for personal non-commercial purposes. Commercial use of AI-generated work remains an evolving area of law — evaluate the risk yourself.
• The App: all IP in live.ai (software, UI, marks, docs) belongs to Talent Limited AI Studio. Reverse engineering, redistribution or commercial use without written consent is prohibited.

6. Disclaimers & Liability

• The Service is provided "as is". We do not warrant that every generation meets your expectations or that the Service is uninterrupted or error-free.
• Force majeure (natural disasters, government action, network outages, provider deprecation) suspending the Service does not constitute a breach by us; we will use reasonable efforts to notify you and protect your credits balance.
• Our aggregate liability for direct, indirect, incidental, special, or punitive damages arising out of your use of the Service shall not exceed the fees you paid in the preceding 12 months.

7. Changes

We may amend these Terms in light of regulation or product changes. Changes will be announced in-app in advance; continued use after the effective date constitutes acceptance.

8. Governing Law

These Terms are governed by the laws of the People's Republic of China (excluding HK/Macau/Taiwan). Disputes shall first be resolved by good-faith negotiation; failing that, either party may bring suit in the People's Court with jurisdiction over our operating location.
